Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns & Exchanges Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's/device's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Ringers Western, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Ringers Western and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Queensland, Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 – CLOTHING FITTING TOLERANCE 

There might be a slight fit and feel difference in the same size across different colours. When it comes to colouring, some colours require more colouring, dye, settling time, than others. This is where the fabric feel 'might' feel a little different across some colours. This is where the fit 'might' feel a little different in the same size in different colours. We encourage you to contact our customer service team to get assistance on size selection to ensure the items are a comfortable and flexible fit.

SECTION  21 – CUSTOMS

Countries outside of Australia (not including NZ or the US) may be subject to additional duties to be paid.

As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you reside in; payment of these is necessary to release your order from customs on arrival.

The final value of your order does not include any additional duties required. The carrier, prior to delivery, will inform you of the additional duties.

If you refuse to pay the duties to release your order, the order will subsequently be returned back to the Ringers Western warehouse and refunded. A shipping & handling fee may be deducted from your refund.

By law, Ringers Western is required to state the correct amount paid for any outgoing international package. Any requests to change this information will be denied.

SECTION 22 - INTERNATIONAL CUSTOMS

You are responsible to know the import regulations for your country. Please research all items to ensure that they are legal for importation PRIOR to ordering. Once the order has left our premises we cannot be held responsible for customs delays. Most countries will have no trouble but we post this disclaimer in the off-chance that there is an issue.

If, by chance, the order is returned to us and you wish to have a refund then we will do so only after we have received the goods back. The refund will be calculated as Total cost, less shipping.

We provide tracking information for all orders so please be diligent and keep track of your orders' progress through the mail system.

We do not have a reship policy. We DO assume that all customers are aware of their own countries' laws and therefore you are responsible for dealing with your countries' customs.

Please know your own import regulations before ordering. It is your responsibility. If customs does not return the products to us we cannot issue the refund to you.

If your order is denied entry into your country, we strongly advise attempting to have the items sent back to us and we will refund your order less shipping.

SECTION 24 - SALES PRICING & PROMOTIONS

We will from time-to-time, make available to you offers & discounts in the form of a Promo Code or Discounted Pricing. These are subject to stock availability or the advertised promotional period. The lowest priced item in the cart will be discounted. All offers, sales discounts and promotions are at Ringers Western’s sole discretion and are subject to variation, completion or withdrawal by Ringers Western without notice. Order placed prior to or after the stated promotional period, are exempt from the sales offer or promotion. Unless specified all Facebook and social media promotions / offers are limited to a one time use per customer. Customers cannot claim offers multiple times across multiple orders unless the ad has stated otherwise. In this instance Ringers Western will not honour orders where it is deemed a customer has tried to access a discount or promotion multiple times. Only one offer may be redeemed at any one time, we do not allow multiple codes to be applied to the same order.

BOOTS POLICY

SECTION 25 - RINGERS WESTERN BOOTS

BOOTS RETURN POLICY

Boots MUST be tried indoors on carpet or a clean, smooth floor.

Boots that have been scuffed or worn outside will not be accepted for return.

All aspects of the boots including packaging and the box must be returned in saleable condition. DO NOT use the box as a means of postage return. As the boot box is part of the product, if it is damaged in any way, this may affect the outcome of your return and could incur a fee for us to replace.

For purchases made either online at www.urbanutopiashops.com or at our Warehouse in Arundel, QLD - Ringers Western will gladly accept EXCHANGES for incorrect size/colour within 14 Days, provided you can provide a copy of the receipt.

To make a claim under this policy, you must return the boots (at your own cost). The first replacement will be free of charge. If further changes are required, the full cost of postage will need to be covered by the customer. Postage costs are non-refundable.

EXCHANGES WILL ONLY BE PROVIDED IF:

The boots are not damaged, marked or scuffed. All the items have been returned in their original packaging. 

EXCHANGES will only be made for a change of size for the same boot as the original purchase. 

In the unlikely case of DEFECTIVE boots, Ringers Western will gladly accept REFUNDS/REPLACMENTS within 30 days of receipt. Proof of purchase and a correctly completed RETURNS FORM will need to be provided.  

Once we have received your boots, they will need to be inspected and a decision made on the outcome of your return. 

PLEASE NOTE: This does not include usual wear and tear. Care instructions must be adhered to in order to obtain a refund/replacement. This will ensure the longevity of your boots. Variations of colouring, shading or other deviations caused by the inherent nature of using natural materials in the manufacturing process are not considered defects.

WEAR AND FIT ISSUES ARE NOT CONSIDERED DEFECTS. RINGERS WESTERN HAS NO LIABILITY FOR THIS AND WARRANTY DOES NOT COVER IMPROPER SIZING PURCHASE OR FIT ONCE A PRODUCT HAS BEEN WORN.

If you have purchased boots from one of our stockists or their online shops, you must contact that store directly about your return/exchange. Only purchases made directly through www.urbanutopiashops.com  or our Head Office Store in Helensvale, QLD can be returned directly to us.

Our Warranty Policy:

Ringers Western guarantees its boots to be free of manufacturer’s defects in workmanship and materials for up to one year from the date of purchase. We will replace, repair or credit faulty items that are within the warranty from purchase date where the fault is deemed to be a direct result of manufacturing fault or materials defect.

Variations of colouring or shading or other deviations caused by the inherent nature of using natural materials in the manufacturing process are not considered defects.

WEAR AND FIT ISSUES ARE NOT CONSIDERED DEFECTS. RINGERS WESTERN HAS NO LIABILITY FOR THIS AND WARRANTY DOES NOT COVER IMPROPER SIZING PURCHASE OR FIT ONCE A PRODUCT HAS BEEN WORN.

The warranty does not cover any damage due to excessive wear, misuse, or damage from external objects.

If your boots have been tampered with, we cannot guarantee that we are able to fix or replace them.

If you experience any material or craftsmanship flaw, please contact us so that our customer support team can assist.    

This Warranty applies to purchases made on our website. If your boot was purchased from a different retailer, you need to contact them first to have any of your concerns taken care of.

PROMOTIONS

Affiliate/Discount Codes

Discount/affiliate codes are not eligible on items in collaboration or limited edition collections.

Bundles Promotions

To complete a bundle the products must be added to cart from the bundle builder and code RWbundles successfully added in checkout. You must apply the code prior to checkout. Cannot be used in conjunction with any other offer. Only items shown in bundle builder are applicable to offer. You may only exchange for a different size on each item. Otherwise, you will be given a store credit for the value of the item you wish to return. You may only purchase one (1) of each type of a bundle per transaction. Promotion can end at any time. New products may be added at our discretion.

Spend Over $149 - Free Gift With Purchase (Free Cap) EXPIRED

  1. Promotion Period (EXPIRED): This offer is valid for orders placed from 19/09/2024, 16:00 AEST - 8/10/2024 10:00, and applies only to a selected range of caps, while stocks last or until Ringers Western decides to end the promotion.
  2. Eligibility: To qualify for the free gift, the cart total at checkout must be at least $149 (excluding shipping costs).
  3. Cap Selection: Customers must manually select a cap from the designated collection to add it to their cart. The cap can also be removed from the cart if desired.
  4. Promotion Application: The promotion must be correctly applied at checkout. No adjustments or refunds will be made for incorrectly applied promotions.
  5. System Limitations: While we strive for accuracy, Ringers Western does not guarantee that the website’s bundle generator will correctly add the free item to your cart. We are not liable for the omission of the free cap in such cases.
  6. Returns: If you return any part of your order for a refund, the free cap must also be returned. Please note that the return form does not list the free item separately. Simply include the cap in your return package.
  7. Customer Support: If you encounter any issues with your order or believe there is an error with the bundle, please contact customer service for assistance.
  8. Online store only

INTERNATIONAL ORDERS

If you are ordering outside of Australia, your order may be subject to customs fees/taxes based on the retail value of the package. These fees are not determined by Ringers Western and are beyond our control.

If you have questions as to why you are billed certain import fees/taxes, or would like a more detailed outline of what to expect when your package arrives in your country, we recommend contacting your local customs office or the courier that directly billed you.

If you refuse to pay these charges, your parcel may be abandoned and Ringers Western will not be held responsible for any loss of funds as a result of this occurrence. If your order is returned to sender, you will be liable to cover the return to sender fees and re-shipping fees.
